How to use these templates

  1. Agree the rent, deposits, term, move-in date, and which repairs the tenant covers (the usual cap is a small amount per repair, with the landlord paying above it).
  2. Open the template and tell the AI the deal: "condo in Mont Kiara, RM 3,200 a month, two years, two months' deposit plus half-month utility deposit, fully furnished".
  3. List the furniture and appliances in the inventory schedule with their condition, and take dated photos on handover.
  4. Print two copies, sign with a witness each, and stamp the agreement at an LHDN office or online through the Stamps portal within thirty days; the tenant usually pays the duty.

What to check in a Malaysian tenancy agreement

  • Stamping is what makes the agreement admissible in court. Duty is small, based on the annual rent, and late stamping carries a penalty, so do it within thirty days of signing.
  • The two-month security deposit is a custom, not a law, but it is what most landlords expect; the utility deposit is usually half a month. Write when and how they are returned, typically within fourteen days of handover after deductions.
  • A minor repair clause with a ringgit cap, say RM 150 per item, settles most disputes about leaking taps and air-conditioner servicing before they start.
  • Early termination usually forfeits the deposit; some agreements allow it after a year with two months' notice. Say which applies.
  • There is no residential tenancy act in Malaysia yet, so the agreement itself is the rulebook. Spell out access, pets, subletting and the renewal rent rather than relying on custom.

Frequently asked questions

Is stamping compulsory?

An unstamped agreement is still a contract, but it cannot be used as evidence in court until stamped and the penalty paid. Stamp it within thirty days to avoid the penalty.

Who pays the stamp duty?

By custom the tenant, unless the agreement says otherwise. Agents often collect it with the first month's rent.

How much deposit can a landlord ask for?

There is no legal cap. Two months' rent plus a half-month utility deposit is the norm; some landlords ask for one month for rooms.

Can the landlord enter the unit?
